Legal Pluralism in Romania: An Interview with Sergiu Miscoiu

Dr. Sergiu Miscoiu was a special guest during the Second Team Meeting, which was held in Montreal last October. He is a lecturer in political science at the Babeş-Bolyai Université in Cluj-Napoca, Romania.

His team and him have developed a project, financed by l’Agence universitaire de la francophonie and led by the University of Ottawa, which focusses on legal pluralism among Romani people. Researchers conducted field work in several communities to observe and document stabors, a sort of popular court administrated by the Romani people themselves without any intervention from the State.

During the meeting, Dr. Miscoiu gave a presentation titled “De facto, non de jure. Incursions into the paradoxes of the practice of customary law by the Romani people in Romania”. He stressed the diversity of these stabor, which can be organized around a table while eating a nice meal or, on the contrary, in a very formal setting reminiscent of our own institutions, depending on the community.
